Buyers Agency
In Texas, like many other states, buyers usually have an agent represent them in the purchase of a home. Although, this was not always the case (agents in the past represented the person who paid them), the state realized that buyers need representation in a transaction as much as the sellers. For buyers and agents, this arrangement has proved to be the most natural and efficient. And guess what? The seller still pays the buyer's agent! Today, unless the agent is selling her own listing, she is free to help the buyer discover anything they want to know about the property including how negotiable the seller may be. If the Realtor is in fact representing both the seller & the buyer, then disclosing to either party details of the others willingness to negotiate is prohibited by the intermediary agency that exists.
